Was atomic test case dismissed to stop a precedent?

WHAT a terrible blow it must be for veterans of atomic bomb tests in the Pacific to see their case thrown out by the Civil Court of Appeal as their appeals were not lodged in time.

One presumes the decision not to let these ex-servicemen, who with their families have lived under the shadow of health problems for most of their lives, push for compensation is to put a halt to a legal precedent.

If this is indeed the case, surely some form of dispensation in this instance would have been just.

After all it took these men many decades to piece together what was happening to them.

And ultimately they were serving their country, therefore were entitled to adequate government protection.
